Terms and Conditions
1. General Information
Pole Position reserves the right to change freely and at any time these Terms and Conditions, without prior notice.
2. User Obligations
The User undertakes in particular to comply with the following:
- To communicate personal data and correct address so that Pole Position can process orders properly;
- Do not use false identities;
- Save, not disclose, your password to access the sites in order to prevent third parties from having access to your account on our sites.
- Be responsible for the accuracy of the data communicated to Pole Position and undertakes to immediately insert into its Registration Account any changes thereto.
Pole Position declines all responsibility for any delay or impossibility of processing the order, namely in the act of delivery, due to error or insufficiency of the data communicated by the Customer.
Users are therefore expressly prohibited from transmitting messages or information that are abusive, misleading, defamatory, obscene or in any way violating the right to privacy or the intellectual or industrial property of others, as well as the provision of any information that may be harmful to third parties or to the site owner.
Pole Position reserves the right to delete the account of the user that performs any of these situations.
3. Product Information and Prices
The prices of products indicated on our sites are presented in Euros, and include VAT at the rate in force. The total value of your order will increase shipping costs if applicable, depending on the total value of your order and / or Pole Position promotional campaigns.
In the event of a computer error, manual, technical or any other origin that causes a substantial change in the sales price, in such a way that it becomes exorbitant or manifestly derisory, the purchase request will be considered invalid and void.
The products and prices on our sites are only valid for orders placed online and may not coincide with our physical store, unless specifically indicated promotions online. During any promotional campaign, the price reduction will apply for the duration of the campaign, and all items covered by the campaign will be limited to the existing stock.
Prices, products, and specifications of the products are subject at any time to change without notice. However, Pole Position undertakes to apply the rates and prices indicated at the time of making the purchase order.
4. Payment options
- Credit Card. For example, VISA, MasterCard, American Express.
- Bank Transfer / Muktibanco. The data for payment by bank transfer or Multibanco is sent via email. Your order will be sent after receipt of the proof or when the amount is actually credited to our account. In order to send your order faster, we ask that you include in the description of your payment the same name that you will use to place your order. If payment is not made after the 15th day, the order will be canceled.
- Cash. If you want to pick up your order directly from our Shop located at Rua Santos Pousada 882, 4000-481 Porto.
Important Note: Your order will only be processed after confirmation of your payment.
5. Means and Shipping cost
Free shipping on orders worth more than € 199 for EU zone and Schengen area, does not apply to orders for highly flammable products such as fuel, batteries and cleaning fluids.
When free shipping does not apply, shipping costs are calculated automatically in the purchase order and available to view before confirming your order.
The shipping methods used by Pole Position are as follows:
- CTT Portugal (CTT)
The most appropriate shipping method is chosen by Pole Position considering the characteristics of the item (s) ordered. However, it is Pole Position's policy that the User has access to the ordered items as soon as possible, so faster delivery services will be used whenever possible.
Important Note: Pole Position only dispatches orders on working days.
Pole Position also processes international orders, outside the European Union and Schengen area. International shipping costs are automatically calculated when you process checkout, however, if the value is very different from the actual, we will contact you with the updated shipping costs. Customs costs are the responsibility of the user.
6. Change or Cancel an order
7. Product Returns & Exchanges
The Pole Position allows the exchange or return of articles, within 15 days from the date of receipt by the User, without payment of compensation and without having to indicate the reason. To do so, the User must communicate his intention in writing, via e-mail email@example.com. The articles must be returned within 15 days after receipt, accompanied by the original bill or invoice (article 6 of DL 143/2001, of April 26 with the wording given by DL 82/2008 of 20 May). The articles must be in perfect condition, in their original packaging and with all the included accessories, and must be accompanied by the respective proof of purchase or the invoice. In no case send the articles without previous contact because they will not be received.
The return and exchange of articles must comply with the following conditions:
- Refund of articles in perfect condition, with full original packaging and accompanied by the respective invoice;
- The articles sealed via the film or bag of the packaging, can not be opened;
- We do not accept exchanges of personalized articles according to the specifications of the User;
The Pole Position does not accept the return or exchange of articles that have already been used or with signs of use.
All articles will be checked upon arrival at our service and only those that comply with the conditions will be accepted for exchange or return. Pole Position reserves the right not to accept articles that do not meet these conditions.
8. Warranty and after-sales service
In case the purchased product is defective or malfunctioning, you should notify Pole Position by sending an email to firstname.lastname@example.org, giving your user name, order number and description of the malfunction.
Costs for returning or collecting items within the warranty period will be borne by the customer.
Some warranty situations are resolved immediately in our store, in other more complex situations the item is forwarded to the brand with a status report and can take at least two weeks.
In the case of out-of-warranty goods, Pole Position also provides technical assistance. After-sales service is provided in our store, or if possible via telephone or email. The repair will only be started after the user has accepted the repair budget.
9. Privacy and Protection of Personal Data
Pole Position guarantees the confidentiality and security of all data provided by its Users. The data collected on our sites is intended for the processing of orders and communication with its Users, processing of requests for information, statistical analysis, as well as their use for the purposes of direct marketing.
The User expressly authorizes Pole Position to send information about products and services that may be of interest to you using your personal data for the purpose of direct marketing through any communication channel, namely through the use of electronic mail, SMS, or other forms. Pole Position will not market or share its User database with third parties.
All Users have the right to access, rectify, cancel and oppose their data. If you wish, at any time, to stop being part of the database you can exercise this right through the email - email@example.com.
10. Intellectual and industrial property
11. Governing Law and Responsibilities
All available products and all purchases made on Pole Position websites are subject to Portuguese legislation. Any conflict or divergence of interpretation of the Terms and Conditions of Use will be submitted to the competent Portuguese Court.
In case our client is outside Continental Portugal, we inform that any legal process should be sent to the Portuguese Courts.
Pole Position declines all liability in case of violation of the legislation of the country where the order is delivered. It is up to the User to verify with the local authorities the conditions of importation or use of the products that he wishes to order.
Pole Position is not liable for any damage resulting from interference, interruptions, computer viruses, malfunctions or disconnections of the operating system that may temporarily prevent access, navigation or service to Users.
